Joseph J. Asterita

Biography

Mr. Asterita is the principal attorney and owner of Asterita & Associates, LLC, – Attorneys At Law and maintains offices located in both Red Bank, New Jersey and Staten Island, New York. He was a partner of Bonfiglio & Asterita, LLC for nearly 20 years until the retirement and untimely passing of his partner, Thomas J. Bonfiglio in 2022. Mr. Asterita has been admitted to practice law in New Jersey since 1999 and New York since 2000 and is also admitted to practice before the United States Federal District Courts for the District of New Jersey and the Southern and Eastern Districts of New York. Mr. Asterita focuses on providing clients with his expertise in three primary practice areas; Real Estate; Wills, Trusts & Estates; and Business Law.

Mr. Asterita provides representation to his individual and business clients in various real estate matters, including residential and commercial purchases and sales, refinances and leases. He has successfully handled numerous related real estate litigation matters and disputes ranging from the enforcement of easements and property lines to the partition and sale of residential and commercial properties.

Mr. Asterita also provides wealth preservation and estate planning services through his estate planning expertise, which includes the preparation of wills and trusts, powers of attorney, living wills and health care proxies together with the skillful incorporation of these instruments into comprehensive estate plans, including long term care or estate tax planning. He further provides representation to clients who have an interest in the settlement of an estate, whether by way of probate or administration, as well as handling estate disputes and related litigation matters involving whether concerning the distribution of an estate’s assets, enforcement of a spousal or child’s right to an inheritance, enforcing or defending creditor’s claims, or involving the failure of an executor or administrator to properly carry out required fiduciary duties.

As an experienced business attorney, Mr. Asterita serves as a trusted advisor to a wide variety of clients ranging in size and type, from individual entrepreneurs, real estate investors, restaurants, retail stores and contractors, to public relations, media, and information technology firms. He effectively handles business formation and structuring needs of his clients as well as succession planning, commercial contracts, leases, and business purchases and sales for businesses of various types and sizes, and has often handled and resolved numerous shareholder and partnership disputes and commercial litigation matters for his diverse clientele.

Mr. Asterita further supervises the firm’s mortgage loan closing department and represents mortgage lenders in connection with the closing and settlement of residential and commercial mortgage loans, whether in connection with a residential or commercial purchase or refinance or reverse mortgages. Mr. Asterita is also experienced in closing refinances that incorporate a CEMA designed to help borrowers avoid the costs of the substantial mortgage recording tax in New York, especially involving properties throughout the five boroughs of New York City resulting in significant borrower tax savings.

Mr. Asterita earned his Bachelor of Arts degree in International Affairs at The George Washington University in 1996 and his Juris Doctor degree from Brooklyn Law School in 1999. Mr. Asterita studied abroad at the University of Bologna, Italy where he focused on Business Law while attending Brooklyn Law School. He is a member of the New York and New Jersey State Bar Associations, the American Bar Association, the Richmond and Monmouth County Bar Associations, the Richmond County Chamber of Commerce and the Eastern Monmouth County Chamber of Commerce.
